Effects of illegal mining on State security in Ecuador

Abstract

Illegal mining constitutes one of the main threats to economic stability, environmental sustainability and security of the Ecuadorian State. Its expansion is linked to illicit economies, corruption, fiscal loss, environmental degradation and the presence of armed actors and supports the economic strengthening of transnational organized crime. This study analyzes the phenomenon from a legal-institutional and economic-strategic perspective, identifying normative gaps and weaknesses in the application of the current legal framework. The Mining Law, the Integral Organic Penal Code (COIP), constitutional jurisprudence and the interaction between the extractive economy and illicit finances are examined. The objective is to demonstrate that illegal mining is not a sectoral problem, but a structural phenomenon that compromises national security and requires an integral response from the Ecuadorian State sustained by interinstitutional coordination, economic stability and normative coherence.

Author Biography

Jorge Luis Tello Coronel, Fuerza Terrestre del Ejercito Ecuatoriano

He entered his military career at the Escuela Superior Militar “Eloy Alfaro”, from where he graduated as Armored Caballerian Warrant Officer on August 10, 1990.
He has a degree in Military Sciences and has a solid fourth-level academic training, oriented towards strategic leadership, security and risk management. Obtained Master's Degree in Military Science at the Nanjing Army Command College, in the People's Republic of China; the Mastery in Risk Management, with mention in Natural Disaster Response, at the SEK International University; and a Diploma in Security and Defense Analyst at the International Security University of Spain.
Throughout his career, Colonel Jorge Tello Coronel has performed several command, advisory and driving roles, both in the operational, academic and institutional spheres, standing out for his professionalism, leadership and commitment to strengthening the capabilities of the Ecuadorian Army and the National Defense System.
