Cybersecurity and personal data protection: challenges and perspectives
Abstract
The growing digitalization in Latin America has positioned personal data protection and cybersecurity as priority challenges. This review article analyzes the current state of these issues in the region, contrasting regulatory advancements with practical obstacles to implementation. Using a systematic methodology that included 47 academic and technical sources, it was found that although 73% of countries have specific legislation (mainly inspired by the European GDPR), critical gaps remain: low levels of business compliance (31% in Ecuador), insufficient investment in security (3.2% of digital spending), and limited public awareness (79% of users do not understand privacy policies). The findings reveal that the financial and healthcare sectors account for 65% of breaches, with sensitive data exposed due to technical and institutional failures. The study proposes a comprehensive strategy based on four pillars: strengthening autonomous authorities, regional harmonization of standards, promoting technological incentives for SMEs, and large-scale digital literacy programs. It concludes that the effectiveness of policies depends on adapting global models to local contexts, combining robust legal frameworks with realistic and culturally relevant implementation mechanisms.
