Administrative law and expectations regarding the use of artificial intelligence

Abstract

Artificial intelligence and its use are generating debate, both in the scientific community and in political circles, due to the accelerated pace of creating systems that can perform tasks that normally require human intelligence. Undoubtedly, artificial intelligence responds to scientific and technological developments over the last decade, which have become increasingly compelling and demanding in relation to the way humans work, think, and act. The incorporation of automated systems into administrative processes not only optimizes operational efficiency but also poses significant regulatory and ethical challenges to ensure transparency and the protection of fundamental rights in the exercise of public functions and in the fulfillment of their management, inspection, and oversight responsibilities, ensuring respect for rights and guarantees. The objective of this article is to analyze the application of artificial intelligence in the management of administrative law processes through a systematic descriptive review. The conclusion is that artificial intelligence generates an "automated administration" that does not always guarantee justice or respect for rights and causes a reduction in the technical autonomy and critical legal capacity of public officials. In conclusion, the incorporation of artificial intelligence into administrative law represents a valuable opportunity to modernize public procedures.
